1. Scope & Defense Clause

(1) These Terms of Service govern the legal relationship between the operator of this website (hereinafter the "Provider") and every user or customer who creates or accesses an account on the site. The version in force at the moment an account is created applies exclusively.

(2) Any deviating or supplementary terms proposed by a customer are expressly rejected and shall not become part of the contract unless the Provider has agreed to them in writing.

2. Disclaimer of Liability

(1) All claims for damages against the Provider are excluded unless otherwise stated below. This exclusion likewise benefits the Provider's officers, directors, employees, agents, and legal representatives if the customer asserts claims against them.

(2) The exclusion in § 2 (1) does not apply to:

  • claims for damages arising from injury to life, body, or health;
  • liability for intentional or grossly negligent breaches of duty by the Provider or its representatives;
  • liability that may not be disclaimed under applicable Delaware or U.S. law.

(3) Except as provided in § 2 (2), the service is offered "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

3. Choice of Law and Jurisdiction

(1) All contractual and non-contractual claims arising out of or relating to these Terms shall be governed by and construed in accordance with the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws principles and without application of the U.N. Convention on Contracts for the International Sale of Goods (CISG).

(2) The exclusive venue for any dispute arising from the contractual relationship shall be the state and federal courts located in Kent County, Delaware. The parties irrevocably submit to the personal jurisdiction of those courts.

4. External Links

This site may contain links ("external links") to third-party websites over whose content the Provider has no control. The Provider therefore accepts no responsibility for those contents; responsibility lies solely with the operator of the linked site. Upon becoming aware of any violation of law, the Provider will remove the link promptly.

5. Severability Clause

Should any provision of these Terms be or become invalid or unenforceable, the remaining provisions shall remain valid. The invalid provision shall be replaced by a valid provision that most closely reflects the parties' original economic intent.

6. Claim Management

The Provider reserves the right, at its sole discretion, to block, suspend, or delete user, publisher, or premium accounts, to modify stored data, and to determine or modify acceptable payment methods at any time without stating reasons.

7. Legal Process

To the fullest extent permitted by law, recourse to the courts is excluded for disputes that can be resolved through the internal complaint and appeal procedures provided by the Provider. Nothing herein waives mandatory statutory rights to judicial relief under Delaware or federal law.

Publisher Accounts

Guidelines for Payouts

All publisher accounts must comply with the following program policies. Violations may result in suspension of specific links or deactivation of the publisher account. Re-registration is prohibited after deactivation.

Guidelines for Linked Websites

  • No links to pornographic or adult content.
  • No links to content that glorifies violence, promotes hate speech, harassment, or bullying.
  • No links to content concerning illegal drugs.
  • No "loop traffic," link chains, or other techniques intended to confuse visitors.
  • No re-monetizing deep links created with this service through comparable providers.
  • No links to copyrighted or otherwise protected content without valid authorization (e.g., unlicensed music or film downloads).
  • No links to deceptive or misleading software.
  • No links to malware, adware, or similar harmful code.

Guidelines for Traffic Sources

  • No self-clicking or artificial inflation of visitor counts.
  • Prohibited traffic sources include, but are not limited to: click-bots, third-party click-generation services, pay-to-click, pay-to-surf, autosurf, and click-exchange programs.
